General

1. These Terms of Entry must be read in conjunction with the Schedule. The Schedule defines the terminology used in these Terms of entry. Where there is any inconsistency between these Terms of entry and the Schedule, the Schedule prevails.

2. The Giveaway will be conducted during the Giveaway Period.

3. By participating in the Giveaway, Entrants agree to be bound by these Terms of Entry.

4. The Prize are specified in the Prize section of the Schedule.

5. The total prize pool is specified in the Total Prize value section of the Schedule.

6. The Prize is valued in Australian dollars unless expressly stated to the contrary.

7. The Promoter is the sole promoter of the Giveaway and is solely responsible for conducting it, including the draw, notification of the winner and the handling of any complaint. Each Prize Partner supplies one or more components of the Prize but does not promote, administer or conduct the Giveaway, does not collect or hold Entrants' personal information, and has no responsibility for the conduct of the Giveaway. Any question, comment or complaint about the Giveaway must be directed to the Promoter.

8. Nothing in these Terms of Entry excludes, restricts or modifies any right or remedy an Entrant has under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.

Third Party Websites

9. Third Party Websites may be used to advertise or promote the Giveaway. By participating in the Giveaway, Entrants agree that the Giveaway is in no way sponsored, endorsed or administered by, or associated with the Third-Party Websites and to release Third Party Websites from all liability in relation to the Giveaway. Any questions, comments or complaints regarding the Giveaway should be directed to the Promoter and not Third-Party Websites.

10. Entrants understand that they are providing their information to the Promoter and to the Third-Party Website when participating in the Giveaway and that Entrants may be subject to the terms and conditions of that Third-Party Website.

Eligibility

11. Entry is only open to the Entrants, excluding the Exclusions (“Immediate Family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin).

12. Entrants agree to show proof of the matters in clause 11 above if requested by the Promoter.

13. The Giveaway will be conducted during the Giveaway Period and Entries must be received by the Promoter for the Giveaway during the Giveaway Period. Incomplete Entries and Entries received after the Giveaway Period are invalid.

Entry

14. To enter, an Entrant must have a current Instagram Account and complete the Entry as described in the Entry/Entries section of the Schedule.

15. Entry to the Giveaway is free. An Entrant may enter the Giveaway (as specified in the Schedule) multiple times during the Giveaway Period, up to the daily limit stated in the Schedule. Each separate comment constitutes one (1) entry. Duplicate or substantially identical comments will be counted as one (1) entry.

16. The Promoter reserves the right to reject an Entry if it reasonably forms the opinion that an Entry has been created and/or submitted using automated entry means or a computer entry service.

17. The Promoter takes no responsibility for any late Entries or for any delays or failures in any telecommunications service or equipment. An Entrant must ensure that the Entry is posted online during the Giveaway Period for the Giveaway.

18. To be eligible to receive the Prize, an Entry must not:

(a)	infringe the intellectual property or other rights of a third party;
(b)	be incomplete or illegible; or
(c)	be unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive or otherwise contain content which, in the Promoter’s reasonable opinion, is inappropriate or objectionable.
	19. The Promoter may, acting reasonably, not accept a particular Entry or disqualify an Entry, or cancel the Giveaway at any time without giving reasons and without liability to any Entrants. Without limiting this the Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity, age and place of residence) and reserves the right, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms of Entry, tampered with the Entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Giveaway. The Promoter will notify a disqualified Entrant of the disqualification and the reason for it. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
	20. Entrants retain ownership of their Entry. By submitting an Entry, each Entrant grants the Promoter a non-exclusive, irrevocable, royalty-free, worldwide licence to use, reproduce, adapt, publish and communicate the Entry, in whole or in part, in any media for the purposes of conducting and promoting the Giveaway and for the Promoter's future marketing, and consents to any act or omission that would otherwise infringe the Entrant's moral rights in the Entry.
	21. The Promoter’s decisions is final and the Promoter will not enter into any correspondence regarding the decisions made.

Prizes

22. The winner will be announced on the @bboxforkids Instagram account and will also be notified via Instagram DM. The winner must then provide the Promoter with their contact email address and postal address within seven (7) days of notification. The Promoter accepts no responsibility for unread, undelivered or incorrectly provided email or telephone information.

23. If the winner does not respond within the period in clause 22, or is found to be ineligible, the Promoter may forfeit that Entrant's entitlement to the Prize and conduct an unclaimed prize draw on the date and at the location stated in the Schedule. The winner of any unclaimed prize draw will be notified and published in the same manner as the original winner.

24. The winner will be mailed the Prize to the address provided within twenty-eight (28) days of the Promoter receiving the winner's postal address. Components of the Prize may be despatched separately by the Promoter or by the relevant Prize Partner and may arrive at different times.

25. The Promoter will not be responsible for any delay in receiving the Prize due to reasons beyond the Promoter’s reasonable control.

26. The winner’s use of the Prize is subject to these Terms of Entry and additional terms and conditions may be imposed by a Prize Partner or by third parties whose services are used in supplying the Prize, with which the winner must comply.

27. The Prize is not transferable and may not be exchanged for cash or other goods or services. The Prize must be taken as a whole and no alternative will be provided, and no compensation will be payable if the winner is unable to use the Prize as such.

28. If any component of the Prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a component of equal or greater value.

29. The Promoter takes no responsibility where it is unable to contact the Prize winner who has not provided correct or complete contact details. If an Entrant’s contact details change during the Giveaway Period, it is the Entrant's responsibility to notify the Promoter. A request to modify any entry information should be directed to Promoter.

30. Images of the Prize in the Post are illustrative only. Minor variations in packaging, colour or product variant may occur.

31. The b.box gift voucher component of the Prize is valid for three (3) years from the date of issue and is subject to b.box's gift card terms.

32. Food products forming part of the Prize are subject to the best-before dates and allergen information shown on their packaging. The winner should check this information before consumption.

Disputes

33. The Giveaway and these Terms of Entry will be governed by the laws of Victoria, Australia.

34. In the case of a dispute, the parties may abide by the rules and process of the Dispute Settlement Centre of Victoria (www.disputes.vic.gov.au/) with respect to mediation. The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. Complaints about the Giveaway should be sent to the Promoter at customerservice@bbox.com.au. The Promoter will acknowledge a complaint within five (5) business days and respond within ten (10) business days.

Your information

35. The Promoter collects Entrants' personal information for the purpose of conducting the Giveaway, identifying and contacting the winner, and delivering the Prize. The Promoter may disclose that information to its service providers for those purposes, and to a regulatory authority where required by law.

36. The Promoter will disclose the winner's name and delivery address to a Prize Partner only to the extent necessary for that Prize Partner to deliver its component of the Prize. Prize Partners must not use that information for any other purpose, including marketing.

37. Entering the Giveaway does not subscribe an Entrant to any marketing communications. The Promoter will only send marketing communications to an Entrant who has separately opted in, and every such communication will include an unsubscribe facility.

38. The Promoter will retain Entry records for twelve (12) MONTHS after the end of the Giveaway Period, or longer where required by law, and will then destroy or de-identify them.

39. The Promoter may publish the winner's Instagram handle and first name for the purpose of announcing the result of the Giveaway, as required by applicable trade promotion conditions. Use of an Entry itself is governed by clause 20.

40. The collection and disclosure of personal information provided in connection with the Giveaway will be handled in accordance with the Promoter’s Privacy Policy which is prepared in accordance with the Privacy Act 1988 (cth) and the Australian Privacy Principles.

41. Entrants should direct any complaints, requests to access, update or correct information to the Promoter. Collection, use and disclosure of information collected in connection with the Giveaway will be handled in accordance with the Promoter’s Privacy Policy which can be located at https://bbox.com.au/pages/privacy-policy,

Risk and liability

42. To the fullest extent permitted by law, and subject to clause 8, Entrants participate in the Giveaway, and use the Prize, at their own risk. Use of the Promoter’s website is governed by terms and conditions located at bbox.com.au/pages/terms-and-conditions.

43. To the fullest extent permitted by law, and subject to clause 8, the Promoter, its related bodies corporate and the suppliers, agencies and other companies involved in the Giveaway assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data.

44. If the Giveaway is not capable of running as planned for any reason (including as a result of technical failures, fraud or causes beyond the Promoter’s control), the Promoter may, acting reasonably, cancel, suspend or change the Giveaway and re-commence it on similar terms, subject to any directions by regulatory authorities.

45. Except for any liability that cannot be excluded by law, and subject to clause 8, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Giveaway, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) if the Prize is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Entrant) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by an Entrant; or (e) use of the Prize. This clause does not exclude or limit any liability for death or personal injury, and does not affect any rights an Entrant may have under Part 3-5 of the Australian Consumer Law.

46. If despite clause 46, the Promoter incurs a liability to an Entrant under any law which implies a warranty into these Terms of Entry which cannot legally be excluded, the Promoter’s liability in respect of the Giveaway is limited, in the Promoter’s discretion, to either resupplying such goods or services as form part of the Giveaway or paying the cost of resupplying those goods or services.

47. Without limiting any of the foregoing, and subject to clause 8, in no circumstances will an Entrant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.

48. Each component of the Prize is supplied by the Promoter or the relevant Prize Partner. Any manufacturer's warranty applying to a Prize component is given by the party identified in that warranty and not by the Promoter. Nothing in this clause limits clause 8.

49. The Promoter will retain records of all Entries, the draw and the result for at least twelve (12) MONTHS after the end of the Giveaway Period, including the output of the random selection program used to conduct the draw.

An Entrant may enter each Individual Giveaway multiple times up to the limit stated in the Schedule, within the Individual Giveaway Period for that Individual Giveaway.
15. Where an Entry arises from a purchase, that Entry is void if the relevant order is cancelled or refunded before the Prize draw for the relevant Individual Giveaway.
16. The Promoter reserves the right to reject an Entry if it reasonably forms the opinion that an Entry has been created and/or submitted using automated entry means or a computer entry service.

b.box understands that internet shopping is different from being able to pick-up and hold items the way you do in a ‘bricks and mortar’ store. That is why we if you are in any way unhappy with your purchase we will happily return/exchange the item/s, provided:

Postage/shipping and handling of products is not refundable unless product is deemed faulty. Under no circumstances will a refund or credit be given if the products received are used, soiled, damaged or without original packaging and/or tags attached. These items will be returned to the customer with the customer responsible for any return shipping costs.

It is suggested that you send your return package by receipted post or express post, as b.box cannot be held responsible for any product lost/damaged in transit. If you have requested a refund, a credit will be issued via the same payment method used within 7 days of receipt of returned goods. If exchanging the item, you may select an alternative product, however if the replacement item is priced higher than the item exchanged you will be required to pay the difference. We charge a minimum shipping charge within Australia when replacing goods (unless faulty, please read below).

Please ensure you open your parcel, check all items are included and are undamaged. Claims for missing or damaged items cannot be accepted after 7 days of receipt.

products deemed faulty

b.box prides itself on quality control and checks all products to the best of its ability before sending them out. If however you believe you have a product that is faulty, please email us as possible during business hours, with your purchase details.

You will be offered a replacement for your faulty item which will be sent to you at our expense. Where you choose to receive a full refund, we will refund you the full purchase price, including shipping. All faults must be reported in writing to b.box within 30 days of purchase. If you purchased more than one item in any single shipment, only the difference in costs of shipping the faulty item will be refunded. Shipping costs on items sent outside Australia are not refundable.

promotional emails

By placing an order with b.box, you authorise us to send you our promotional emails, exclusive sale offers and new product updates from time to time. If you do not wish to receive our promotional emails, please reply to your order confirmation with the 'unsubscribe' in the subject line.

gift cards

Gift Cards are not redeemable for cash, cannot be refunded by the purchaser and are valid only for the addressee. They can be used on all products, including sale items. Gift Cards are valid for 3 years from date of issue, unless specified otherwise

refusal to supply services or products

b.box reserves the right to refuse or discontinue supply or services of any products without notice to persons who are deemed to engage in conduct or activities that b.box believes violates any of the a forementioned terms and conditions.
